الملخص
تتناول هذه الدراسة موضوعا ذا أهمية يتمثل في التطورات التكنولوجية واثرها على تنفيذ عقد الشغل ،والشغل عن بعد على وجه الخصوص باعتباره نموذجا بارزا لهذا التحول ،حيث تسعى الدراسة الى بحث مدى تأثير الوسائل التكنولوجية الحديثة على طبيعة عالقة التبعية ،ال سيما من خالل ظهور التبعية عن بعد وما أتاحته تقنيات االتصال واملراقبة من وسائل جديدة لتوجيه االجير وتتبع أدائه دون الحاجة الى حضوره المادي داخل المقاولة ،كما تتناول الدراسة حدود سلطة المشغل في مواجهة الحياة الخاصة لألجير ،بالنظر الى ما تتيحه التكنولوجيا من إمكانيات ملراقبة االتصاالت والنشاط المنهي وحتى الولوج الى المجال الخاص لألجير ،بما يطرح ضرورة تحقيق التوازن بين متطلبات تنفيذ عقد الشغل وحماية الحقوق والحريات الفردية لألجير.

Abstract
This study addresses an important issue concerning technological developments and their impact on the performance of employment contracts, with particular emphasis on remote work as a prominent example of this transformation. It seeks to examine the extent to which modern technological means have affected the nature of the employment relationship of subordination, particularly through the emergence of the concept of remote subordination (Télé-subordination) and the new means provided by communication and monitoring technologies for directing employees and tracking their performance without requiring their physical presence within the workplace. The study also examines the limits of the employer’s authority in relation to the employee’s private life, given the possibilities offered by technology to monitor communications and professional activities, and even to intrude into the employee’s private sphere. This raises the need to strike a balance between the requirements of performing the employment contract and the protection of the employee’s individual rights and freedoms.
