Résumé

La dématérialisation des documents commerciaux constitue l'un des leviers structurants de la modernisation douanière contemporaine. Au Maroc, la généralisation du « zéro papier » à compter du 1er janvier 2019, adossée au système BADR et au guichet unique PortNet, a profondément transformé le rapport de l'administration des douanes à l'écrit et, partant, la temporalité même du dédouanement. La présente étude interroge la portée juridique de cette mutation en confrontant le régime de la preuve électronique, issu de la loi n° 53-05 puis de la loi n° 43-20, aux exigences opérationnelles de fluidité des flux transfrontaliers. Elle démontre que l'équivalence fonctionnelle reconnue à l'écrit et à la signature électroniques a doté les documents commerciaux dématérialisés d'une valeur probante suffisante pour fonder la déclaration en détail, tout en accélérant la mainlevée par la gestion automatisée du risque. L'analyse met néanmoins en lumière la persistance de limites tenant à l'archivage à valeur probante, à l'interopérabilité transfrontalière des signatures et à la protection des données. Elle conclut à une fluidité réelle mais conditionnée par le parachèvement du cadre normatif de la confiance numérique.

Abstract

The dematerialization of commercial documents has become a structuring driver of contemporary customs modernization. In Morocco, the generalization of the « paperless » clearance process as of 1 January 2019, supported by the BADR system and the PortNet single window, has deeply reshaped the customs administration's relationship to the written instrument and, consequently, the very temporality of clearance operations. This study examines the legal scope of this transformation by confronting the regime of electronic evidence, arising from Law No. 53-05 and then Law No. 43-20, with the operational requirements of trade flow fluidity. It demonstrates that the functional equivalence granted to electronic writing and signatures has endowed dematerialized commercial documents with probative value sufficient to ground the detailed declaration, while accelerating the release of goods through automated risk management. The analysis nonetheless highlights persistent limits relating to evidentiary archiving, cross-border interoperability of signatures, and personal data protection. It concludes that the fluidity achieved is real but conditioned upon the completion of the normative framework of digital trust.
