Abstract

This study examines the legal framework governing the kafala of abandoned children in Moroccan law under Law No. 15.01, with a view to assessing its ability to ensure effective child protection and uphold the best interests of the child. While highlighting the legal coherence of this institution, rooted in the principles of Islamic law, the article points to the gap between the normative framework and its practical implementation. It identifies the main challenges arising from procedural delays, insufficient coordination among institutional stakeholders, and the limitations of post-kafala monitoring. In light of these findings, the study puts forward several proposals aimed at enhancing the effectiveness of the legal framework governing kafala.
