Résumé
La protection de la vie privée est un droit fondamental. Aujourd’hui, la numérisation de la santé, portée par l’intelligence artificielle (IA) et le Dossier Médical Partagé (DMP), transforme radicalement la médecine. Si ces innovations promettent une meilleure prise en charge, elles soulèvent des défis majeurs pour la confidentialité et la sécurité des données. Ces informations dites sensibles sont strictement protégées par le RGPD en Europe et la loi 09-08 au Maroc. L’un des défis majeurs est l’anonymisation qui expose souvent au risque de « ré-identification ». Entre la volonté de la coordination des soins, leur continuité et la garantie d’une meilleure qualité, la numérisation semble être une solution prometteuse. Cependant, le risque de porter atteinte aux données de santé augmente. Ce qui peut entraîner une rupture de la confidentialité. En conclusion, la dématérialisation transforme le secret médical classique en un « secret partagé ». Cela impose une vigilance accrue, des règles de sécurité strictes pour les hébergeurs et une adaptation constante du droit face aux évolutions technologiques.

Abstract
Privacy is a fundamental right. Today, the digitization of healthcare driven by artificial intelligence (AI) and the Shared Medical Record is radically transforming medicine. While these innovations promise improved patient care, they also pose significant challenges regarding data confidentiality and security. Such sensitive information is strictly protected by the GDPR in Europe and Law 09-08 in Morocco. A major challenge is anonymization, which often carries a risk of «re-identification». Digitization appears to be a promising solution for balancing care coordination and continuity with the assurance of higher quality care. However, the risk of compromising health data is increasing, which can lead to a breach of confidentiality. In conclusion, digitization transforms traditional medical confidentiality into «shared confidentiality» This necessitates heightened vigilance, strict security rules for hosting providers, and constant legal adaptation to keep pace with technological developments.
