Abstract

Maritime transport plays a key role in Morocco’s foreign trade, a sector that has undergone major upheavals thanks to digital technologies. This article aims to examine the impact of digitalization on Moroccan maritime transport law, highlighting the developments affecting both port logistics and the legal tools of transport. The issue guiding this analysis is as follows : How does the technological revolution impact Moroccan maritime transport and its legal framework ? In this article, we explore the digitalization of Moroccan ports, focusing on initiatives such as PortNet and the « Smart Port » program. These efforts have played a key role in improving the fluidity of exchanges and the competitiveness of the sector. Nevertheless, these technical advancements face obstacles due to a national legal framework that is still largely outdated, particularly the oldest Maritime Commercial Code. Furthermore, the study on the dematerialization of transport documents, notably the electronic bill of lading and the maritime transport letter, highlights limitations regarding electronic evidence, the security of exchanges, and the legal recognition of digital media. Therefore, the article emphasizes the necessity of reforming Moroccan maritime law to ensure better alignment with technological developments and the demands of international trade.

Keywords
