الملخص
تتناول هذه الدراسة إشكالية إصالح مجموعة القانون الجنائي المغربي في ظل تصاعد معدالت الجريمة وظهور أنماط جديدة مرتبطة بالتحوالت العلمية واالجتماعية والثقافية .وقد ركز البحث على موضوع تقنين اإلجهاض باعتباره من أبرز القضايا التي أثارت جدال حقوقيا وإيديولوجيا واسعا .وتنبع اإلشكالية من تغييب صوت المرأة ،رغم كونها الفاعل الرئيس في قرار اإليقاف اإلرادي للحمل. منهجيا ،اعتمدت الدراسة على مقاربة ميدانية تجريبية من خالل استجواب عينة من األمهات العازبات ،قصد رصد دوافع اللجوء إلى اإلجهاض أو االستمرار في الحمل ،وتحليل العوامل االجتماعية والنفسية المؤثرة في القرار. وتهدف الدراسة إلى تقديم معطيات واقعية حول انعكاسات اإلجهاض على المرأة ،وتقييم أثر تقنينه على البنية األخالقية واالجتماعية ،بما يسمح بإغناء النقاش القانوني والحقوقي وإرساء سياسة جنائية أكثر انسجاما مع الواقع المغربي.

Abstract
This study addresses the issue of reforming the Moroccan Penal Code in light of the rising crime rates and the emergence of new patterns linked to scientific, social, and cultural transformations. The research focused on the topic of legalizing abortion, considering it one of the most prominent issues that has sparked extensive legal and ideological debate. The issue arises from the silencing of women’s voices, despite being the primary actors in the decision to voluntarily terminate a pregnancy. Methodologically, the study relied on an experimental field approach by interviewing a sample of single mothers, aiming to identify the motivations for resorting to abortion or continuing with the pregnancy, and analyzing the social and psychological factors influencing the decision. The study aims to provide realistic data on the impacts of abortion on women and to assess the effect of its legalization on the moral and social structure, thereby enriching the legal and human rights discourse and establishing a criminal policy more in line with Moroccan reality.
