Abstract
This study examines the criminal protection of physical integrity against the risks posed by implantable electronic microchips in the human body, through a comparative analytical approach combining technical, criminal, and constitutional dimensions. The study proceeds from identifying the qualitative transformation that this technology has brought to the very concept of physical integrity, which is no longer confined to its direct material dimension but has expanded to encompass the digital dimension relating to the security of data stored in the chip and the individual's right not to be monitored or tracked without informed consent. The study reveals that the Moroccan criminal system suffers from a structural deficiency in addressing these risks, manifested in three interrelated gaps affecting criminal qualification, attribution of liability, and proportionality of punishment, against a backdrop of a clear legislative vacuum in the Penal Code, Labour Law No. 65-99, and Law No. 09-08 on the protection of personal data. In response to this deficiency, the study examines three comparative legislative models with distinct philosophical underpinnings: the American model based on independent specialized legislation, the European model based on extending existing general frameworks such as the GDPR and AI Act, and the Emirati model based on developing the general cybercrime framework. The study concludes that the optimal approach for the Moroccan legislator combines two complementary paths: urgent partial amendments to existing texts, alongside independent specialized legislation that fully accommodates the specificities of this technology and establishes a comprehensive protective framework informed by comparative legal experience.
