Abstract
This article examines scientific evidence in environmental crimes under Moroccan criminal law, drawing on comparative experience. It distinguishes three levels of proof that are often confused in practice: proof of the material fact, such as the presence of pollution or the exceedance of legal standards; proof of the source of the harm and its attribution to a specific person or facility; and proof of the causal link between the conduct and the result where the result is an element of the offence. The study shows that the scientific nature of environmental damage, the multiplicity of pollution sources and the delayed manifestation of harm make technical expertise and laboratory analysis indispensable, without removing the discretion of the criminal judge or the principle that doubt benefits the accused. It concludes that sampling protocols and chain of custody should be standardised, laboratory accreditation and expert independence strengthened, and the defence allowed to challenge expert findings and request counter-expertise, while making wider use of endangerment offences that do not require proof of actual harm.
Keywords: environmental crime, scientific evidence, causation, technical expertise, judicial conviction, endangerment offences, scientific uncertainty.
