Abstract
This article examines the philosophical and intellectual background of the emergence of the human rights system. It focuses on a central argument: that the growth and advancement of the idea of human rights cannot be confined to the domain of legal struggles associated with the reality of revolutionary, protest, and militant movements in the streets of the West and the world at large, which produced a set of charters and agreements signed as rights-based achievements. Rather, the philosophical foundation of the idea of human rights played a prominent role in creating a conducive environment saturated with the notion of universal human rights. This is achieved by focusing on three fundamental references, all grounded in human freedom: in this context, we discuss the theory of natural law through a return to the deepest origin in the human being to liberate him from the master; then the social contract theory, which rethought the material and human nature of political power to liberate the human being from the tyrant; and finally, the struggle for religious freedoms through the separation of what is religious from what is political, in order to liberate the human being from the surveillance of theology and its monopoly over human reason and will; as a being who was born free, and therefore cannot but live as such.
