الملخص
يتناول هذا المقال الآثار القانونية المترتبة على سلوك مسطرة الخلاصة الإصلاحية المنظمة بالفصل 83 من ظهير التحفيظ العقاري، باعتبارها آلية تمكن صاحب الحق العيني الذي نشأ أو تغير أو أقر به أثناء جريان مسطرة التحفيظ من إشهار حقه وتحصينه من الأثر التطهيري لقرار التحفيظ. ويسعى إلى رصد انعكاسات هذه المسطرة على إجراءات التحفيظ وعلى المراكز القانونية لأطرافها، مع التركيز على الإشكالات التي يثيرها تطبيقها في ضوء العمل القضائي، ولا سيما اجتهاد محكمة النقض. ويقف المقال بوجه خاص عند الآثار المترتبة على مواصلة إجراءات التحفيظ في اسم المستفيد من الحق، في حالتي التفويت الكلي والجزئي، وذلك خلال جريان المسطرة، من حيث فتح أجل جديد للتعرض ونطاقه وتغيير أطراف الدعوى ومن له الصفة في الطعن، ثم بعد صدور قرار التحفيظ، من حيث استفادة المستفيد من الأثر التطهيري وحدود هذا الأثر في مواجهة الخلف الخاص. ويخلص إلى إبراز دور العمل القضائي في ضبط نطاق هذه الآثار، وإلى اقتراح تدخلات تشريعية تسد الفراغات التي كشف عنها التطبيق.

Abstract
This article examines the legal consequences of resorting to the rectifying summary procedure provided for in Article 83 of the Moroccan Land Registration Dahir. This procedure enables the holder of a real right created, modified or acknowledged while registration proceedings are pending to publicise that right and shield it from the purging effect of the registration decision. The article analyses the implications of the procedure for registration proceedings and for the legal positions of the parties, with particular emphasis on the issues raised by its application in judicial practice, notably the case law of the Court of Cassation. In particular, it addresses the consequences of continuing registration proceedings in the name of the beneficiary of the right, in cases of total or partial transfer, both while proceedings are pending (the reopening of the opposition period and its scope, the substitution of parties and standing to appeal) and after the registration decision (the beneficiary's enjoyment of the purging effect and the limits of that effect vis-à-vis the particular successor). It concludes by highlighting the role of judicial practice in defining these consequences and by proposing legislative adjustments to fill the gaps revealed in practice.
