الملخص
تعد حرية الصحافة الإلكترونية من مظاهر حرية التعبير ووسيلة أساسية في تكوين الرأي العام ومراقبة أداء المؤسسات، غير أن ممارستها تظل مقيدة باحترام حقوق ومصالح الغير. لذلك جرم المشرع المغربي، بموجب قانون الصحافة والنشر رقم 88.13، بعض الأفعال التي تتجاوز حدود الحرية الصحفية، ومن بينها التحريض على ارتكاب الجرائم ونشر الأخبار الزائفة، بما يقتضي تحديد مفهوم هذه الأفعال وأركان المسؤولية الجنائية المترتبة عنها.

Abstract
Electronic press freedom is a form of freedom of expression and an important means of shaping public opinion and monitoring institutions. However, its exercise must respect the rights and interests of others. Accordingly, Moroccan Law No. 88.13 on Press and Publication criminalizes certain acts that exceed the limits of journalistic freedom, including incitement to commit crimes and the dissemination of false news, requiring an examination of these offenses and the elements of resulting criminal liability.
